2. Scope
These Terms apply to contracts with consumers and business customers for coaching, consulting, trainings and workshops (online/on-site) as well as digital products and digital content (online courses, videos, audios, PDFs, templates, recordings) offered via guruinyou.de or agreed directly (email/phone/video).

3. Definitions
“Consumer” means a natural person acting mainly outside trade/business. “Business customer” acts in the course of trade/business. “Digital content” means data supplied in digital form.

4. Services
The scope follows the website description, an offer, or an individual agreement. Coaching/consulting is a support process; no specific outcome is guaranteed. Digital content is licensed under section 13.

5. Contract formation
A contract is formed upon written confirmation, booking confirmation (incl. scheduling tools), or payment where communicated as acceptance. The provider may refuse requests without stating reasons.

6. Prices, small business status, payment
Prices are as agreed. As a small business under Section 19 German VAT Act (UStG), no VAT is charged and no VAT is shown.
Unless agreed otherwise, payment is due immediately. Statutory rules apply in case of late payment.

7. Appointments, rescheduling, cancellation (24h rule)
Cancellations/rescheduling are free up to 24 hours before the appointment (receipt of notice is decisive). Later cancellations or no-shows are charged 100% unless the slot can be rebooked.

8. Client duties
Clients provide accurate information and ensure suitable technical setup for online sessions (stable internet, device, quiet environment). Issues within the client’s responsibility do not create refund claims; we aim for a fair solution subject to availability.

9. No medical/therapeutic services
Coaching/consulting does not replace medical, psychological, or psychotherapeutic diagnosis or treatment. No diagnoses or healing promises are made. In acute crises, seek professional help.

10. Digital products: delivery, access, availability
Digital content is provided via download link, email, member area, or streaming. Delivery is immediate after payment, unless a later date (e.g., course start) is explicitly stated.
Access is unlimited, as long as operating the product remains technically and economically reasonable. The provider may change platforms/tools if access to equivalent content remains available. Platform availability cannot be guaranteed at all times (maintenance, outages); we strive to resolve issues promptly.

11. Updates
We may update or technically adjust content while keeping the core of the service for maintenance, security, or improvement reasons.

12. Recordings (optional)
If sessions/webinars are recorded, this will be communicated in advance. Recordings must not be shared or published (see section 13).

13. Intellectual property, license, no sharing
All materials are protected. Clients receive a non-exclusive, non-transferable, non-sublicensable license for personal/internal use only. Copying, sharing, reselling, publishing, making publicly available, or training third parties with the materials is prohibited without written permission. Access may be suspended in case of breach.

14. Confidentiality
Both parties keep confidential information confidential, subject to mandatory legal disclosure.

15. Liability
Unlimited liability for intent, gross negligence and injury to life/body/health. For minor negligence, liability is limited to essential contractual duties and foreseeable typical damages. Otherwise excluded to the extent permitted by law. Clients act responsibly for their own decisions.

16. Consumer withdrawal (EU/EEA consumers)
Consumers have a 14-day withdrawal right where applicable. If the consumer requests performance to begin during the withdrawal period, a proportional amount may be due for services already rendered. For digital content not supplied on a physical medium, the withdrawal right may expire once performance begins after explicit consent and acknowledgment of losing the right.
Recommended checkout wording (digital content):
-
“I expressly agree that performance starts before the withdrawal period ends.”
-
“I acknowledge that I lose my right of withdrawal once performance begins.”

17. Business customers
No withdrawal rights apply to business customers. Jurisdiction for merchants/business customers is Starnberg (Germany).

18. Data protection
See the Privacy Policy on guruinyou.de.

19. Final provisions
German law applies, subject to mandatory consumer protection rules. Severability applies.
